June 2005 the Plaintiff Andre Murray as Contractor and the Defendant Betty Rose Danielski as Contractee entered into a Continuing Contractual Agreement for Maintenance and Property Management services of civic address 29-31 Marshall Street, Fredericton, New Brunswick.

Renovations in accordance with the signed Contractual Agreement for Maintenance and Property Management services of civic address 29-31 Marshall Street, Fredericton, New Brunswick signed June 2005 commenced July 2005 at civic address 29 -31 Marshall Street at the expense of Plaintiff Andre Murray.

Plaintiff ANDRE MURRAY did faithfully and according to the terms of the contract pay all costs for the repairing, improving and maintenance of civic address 29-31 Marshall Street, Fredericton, NB beginning July 2005 and continues to this date.

The plaintiff ANDRE MURRAY has not at any time since the beginning of the contract  failed to perform as contracted and consequently has performed honourably..

The terms of the contract referred to in paragraph 1 of this Amended Statement of Claim state specifically that on the fourth year of the contract the contractor may request of the beneficial owner BETTY ROSE DANIELSKI to perform the transfer of the title from the name of BETTY ROSE DANIELSKI and into the name ANDRE MURRAY .

Failure of the Defendant BETTY ROSE DANIELSKI to perform transfer of the title, according to terms of contract as previously stated in paragraph 16 of this Amended Statement of Claim, when requested by plaintiff Andre Murray causes all costs and expenses to date, which where to the benefit of BETTY ROSE DANIELSKI and or the estate of BETTY ROSE DANIELSKI and suffered by Andre Murray to become payable retroactive to July, 2005 and immediately due.

Andre Murray under the Mechanics’ Lien Act claims $80,000 a lien upon the estate of Betty Rose Danielski of civic address 29-31 Marshall Street, Fredericton, County of York and Province of New Brunswick. Registered in the York County registry Office, New Brunswick, April 16 2009, # 27035311

September 27, 2011 at 2:00 PM I called the number which I was given by D. S. Hughson and spoke to Lori Daniels who directed me to call the secretary of the Chief of Police Tanya Ramsay to make an appointment and at that time I could affect Service. Further I was instructed to call ahead to make appointments to serve the other officers so as to effect timely and efficient service upon them.

In attempting to serve the various members of the FREDERICTON POLICE FORCE September 28, 2011 I André Murray did e-mail Tanya Ramsay Assistant to Barry MacKnight Chief of Police FREDERICTON POLICE FORCE at email address (Tanya.ramsay@fredericton.ca) and further, called the office several times to expedite matters.  I indicated to Tanya Ramsay, that I have been advised by the City solicitor's office, that Tanya Ramsay would facilitate me, to meet with and or make appointments, to meet with certain members of FREDERICTON POLICE FORCE at Fredericton City Police Force office, located at 311 Queen Street, Fredericton N.B. E3B 1B1. Namely Chief of Police Barry MacKnight, Sergeant Matt Myers, Constable Mike Fox, Constable Patrick Small, Constable Nancy Rideout, Constable Debbie Stafford, Constable Michael Saunders. I André Murray advised Tanya Ramsay that I have documents of a legal nature which are time sensitive and require immediate Service.

SERVICE RULE 18 SERVICE OF PROCESS 
18.01 When Personal Service is Necessary Originating Process 
(1) An originating process 
(a) shall be served personally unless provided otherwise by an Act or by these rules, and 
(b) need not be served on a party who has filed and served a defence. Other Documents (2) Other documents need not be served personally unless personal service is expressly required by an Act, these rules, or an order of the court. 
 
18.10 Proof of Service 
(1) The service of a document may be proved by an affidavit of the person effecting such service (Form 18B). 
(2) The personal service of a document by a sheriff or his deputy may be proved by a Certificate of Service (Form 18C) endorsed on a copy of the document served. 
(3) The written admission or acceptance of service by a solicitor is sufficient proof of service and need not be verified by an affidavit.

RULE 18
SERVICE OF PROCESS

Service by Prepaid Mail or Prepaid Courier

(3) Where personal service of a document may be
made by leaving a copy with a person pursuant to Rule
18.02(1), such service may be made anywhere in Canada
by sending a copy of the document, together with an Ac-
knowledgement of Receipt Card (Form 18A), by prepaid
mail or prepaid courier addressed to the person at the last
known address of the person.

(4) Service by prepaid mail or prepaid courier shall
be deemed to have been effected only if any one of the following
is returned to and received by the sender:

(a) the Acknowledgement of Receipt Card bearing a
signature which purports to be the signature of the person
to whom the document was sent;

(b) a post office receipt bearing a signature which
purports to be the signature or a copy of the signature
of the person to whom the document was sent;

(c) any other form of acknowledgement of receipt in
writing bearing a signature which purports to be the
signature or a copy of the signature of the person to
whom the document was sent; or

(d) confirmation in writing from the carrier that the
document was delivered to the person to whom the
document was sent.

(5) Service by prepaid mail or prepaid courier shall
be deemed to have been effected on the date the sender receives
a receipt or confirmation under paragraph (4).
